I'd assume their rationale is the same expressed by the liquor lobbies here, and it has validity.
There is no other crime or offense where you cause no injury or damage to a person, place or thing, yet go to jail or get fined or lose a license.
It's different if there's actually a crash where some liability incurs, but for cops & lawyers in America DUI law is just a country club industry. Jails full of guys getting pulled over for failing to signal a turn or doing 40 in a 35, then forced into a sobriety test.
There's absolutely no reason LE couldn't drive the individual home, rather than impound a vehicle & initiate a crime & civil process.
