Kansas’ History of Gambling

The history of gambling in Kansas is not unlike many states, especially one in the Midwest. To clean up its rough image in Dodge City, the state of Kansas banned all forms of gambling back in 1868. This would later be revised in 1895 to allow for some gambling at state fairs, but otherwise, things were largely off-limits for decade after decade.

Even when Kansas started doing horse races at the start of the 20th century, these races would not have wagering on them. It was not until 1986 that Kansas approved pari-mutuel betting for horse and dog racing. Six years later, they allowed simulcast wagering on horse racing too.

The state approved a lottery in 1986. But the 80s were a crucial time for gambling in Kansas and throughout the country. The passing of the Indian Gaming Regulatory Act in 1988 led to the creation of tribal casinos in many states around the country. Kansas would agree to the building of them on tribal land, and the first one (Golden Eagle Casino) opened in 1996.

It was not until 2006 that Kansas approved the construction of state-owned casinos, and that was approved by the Kansas Lottery Commission, which would become the first state lottery to be in charge of the state’s casinos. The first one (Boot Hill Casino) opened in 2009 and there are now four of them.

But while casinos were in, horse racing was on the way out with Kansas’ top three racetracks all closed for good by 2011. They were unable to get support for the inclusion of slot machines at the racetracks to boost revenue, and the country’s waning interest in attending races led to bankruptcy and the end of live racing in the state.

But in the 2010s, there was a shift towards online betting as technology grew. Daily Fantasy Sports (DFS) were becoming a big thing with DraftKings and FanDuel leading the way. In 2015, Kansas became one of the first states to legalize DFS.

The real turning point came in 2018 when PASPA was overturned by the Supreme Court, giving states the right to choose to legalize gambling or not. Kansas tried for a couple of years to get the legislation right, but it was slow-moving with opposition from various politicians and casinos on how the revenue sharing and tax rates would work.

Finally, Senate Bill 84 (SB 84) was revised and put through a vote in 2022, passing in both the House and Senate, which allowed it to be signed into law by Governor Laura Kelly. This legalized retail sports betting and online sports betting in the state of Kansas, which was launched last September.

In February, it was reported that Kansas had its biggest month yet in gambling handle, topping $200 million for the first time in January 2023. The wait for legal online poker and casino games remains in Kansas, but things are looking much brighter than they did five years ago.
