The History of West Virginia’s Gambling Laws

West Virginia has a long and favorable history with gambling in the Mountain State. It started back in 1931 when the West Virginia Racing Commission was formed to oversee horse racing activities in the state. Two years later, bets were being placed as pari-mutuel wagering became popular. 

Things took on a more modern approach in 1984 when ‌voters approved a state lottery, establishing the West Virginia Lottery Commission in 1985. By 1994, the Racetrack Video Lottery Act was passed to start introducing slot machines and video poker terminals in the state. But once these started showing up in bars and restaurants throughout West Virginia, there was concern over this gambling market growing out of control.

In 2001, Gov. Bob Wise passed a bill to allow the state to regulate, tax and limit machine gambling in the state at the four racetracks. The minimum bet at a slot machine was raised from $2 to $5, and this bill hoped to increase revenue by $72 million in the state.

In 2007, table games and poker were allowed at the racetrack casinos (racinos) in the state, making them more like commercial casinos. By 2010, the Greenbrier added a new casino floor to give the state five land-based gambling establishments. 

Sports betting was starting to heat up as a debate topic in the country again as the PASPA ruling of 1992 largely made it illegal throughout the country. But with Daily Fantasy Sports growing in popularity, there was a demand to bring back legal retail sportsbooks. In 2018, PASPA was overturned by the Supreme Court, allowing each state to have the right to legalize sports betting.

West Virginia was one of the fastest to do so in 2018, becoming the fifth state to legalize in-person sports betting at land-based sportsbooks. A few months later, it was the third state to legalize online sports wagering with licensed operators.

In March 2019, the West Virginia Lottery Interactive Wagering Act was passed to legalize online casino gaming and online poker. However, none of the top online poker sites have stepped up to the West Virginia market as of 2024.
