Recent Developments for Sports Betting in Nebraska

In 2018, the Supreme Court struck down the PASPA ruling from the 1990s as unconstitutional. This lifted the ban on sports betting across the United States, giving sports betting legalization power to individual states.

Since then, roughly half the states and territories in the country have passed some legal form of sports betting with more in the process of doing so.

When it comes to Nebraska, the wheels were set in motion in November 2020 when voters decided to allow the construction of casinos with Vegas-style games and retail sports betting.

A bill was passed and signed by Governor Pete Ricketts in May 2021, making it legal to construct six retail casinos through the state’s horse racing tracks. This will essentially turn them into racinos that will offer slot machines, table games and retail sportsbooks for in-person sports betting. No part of the law was passed to expand this to online sports gambling.

In 2022, the WarHorse Casino Lincoln opened as the first of these racinos at a temporary location while the main establishment is still being built. Similar temporary sites have been built for other racetracks as they await their grand openings in the next year or two.

Due to the lack of available space at these temporary sites, none of them have started taking in-person bets with retail sportsbooks. Once the real casinos are opened, it is expected that many popular sportsbooks will open up shop at these six locations, including FanDuel Sportsbook, DraftKings Sportsbook, BetMGM, Caesars Sports and more. A license is required to operate in the state and there should be no problem for these companies to secure one with the Nebraska Gaming Commission, which oversees the gambling operation in the state.

Currently, though, there is still no venue you can visit in Nebraska to place legal sports wagers in person. When that time does come, there will be some restrictions similar to other states that prohibit any wagers placed on in-state collegiate teams like the Nebraska Cornhuskers. Prop bets also will not be allowed.

Finally, there is still no bill in place, let alone any law passed, that will legalize online sports betting for Nebraska with sites like FanDuel and DraftKings. You can only use the daily fantasy sports option on those sites at this time.

The only way to get access to sports betting today without any restrictions in Nebraska is to join an offshore sportsbook like one of the 10 we just reviewed. The day will hopefully come soon enough when there are more options than that, but until it does, this is what you need to do.

  • 2022: The WarHorse Casino in Lincoln, Nebraska’s first major casino, opens. After five weeks of operation, the casino contributes nearly $800,000 to state property tax relief.
  • 2020: Senator Justin Wayne introduces bill LB990 or the Games of Skill Act, that would reclassify things such as sports betting and poker as skill-based games and not chance-based gambling. This would stop them from being prohibited under anti-gambling laws. The bill has not passed. Also, Nebraska’s racebooks are granted permission to start including casino games on-site, making them racinos that could soon feature retail sports betting. But mobile sports betting has not been approved in any form yet.
  • 2018: The Professional and Amateur Sports Protection Act (PASPA), which effectively banned U.S. sports betting in 1992, is overturned by the Supreme Court, giving each state the choice to legalize sports betting.
  • 2017: A bill to legalize daily fantasy sports (DFS) in Nebraska was introduced but not passed. Nebraska residents are eligible to play DFS despite its legal status.
  • 2004: Over 64% of voters said no to what could have been the addition of two casinos in the state.
