States laws that permit some form of gambling in-state while making it a crime for out-of-state entities to accept the same wagers from their residents are particularly vulnerable to attack. While many of the most obvious laws at risk concern pari-mutuel account wagering, the same questions concerning constitutionality are equally applicable to state legislation concerning on-line gaming.
