This week the Malta-based bookmaker accused the Italian regulator Amministrazione Autonoma dei Monopoli di Stato of maintaining the blockade in contravention of the Rome Civil Court\’s order. Astrabet announced that the company intends to launch further litigation seeking to compel the regulator to abide by the court ruling.
Jamma.it reported a dispatch released yesterday by Astrabet:
Today a Court Enforcement Officer visited the offices in Rome of AAMS (Administration of the State monopolies) in order to enforce with immediate effect the ruling obtained the 10 April 2006 from the Court of Rome (Second Division). This ruling specifically ordered to the Minister of Economy and Finance – Administration of the State monopolies – the immediate reinstate our site to internet, so that the domain Astrabet.com is associated with the address IP of the server of Astrabet Ltd. The final result would be that the resistant part removes all actions that would stop the access to our site.
The visit of the Court Enforcement Officer has taken place at the presence of Dot. Gabriella Alemanno (General Administration) who has declared that the Administration will take necessary action but they are not in position to operate directly on the net immediately.
Since our site www.astrabet.com is still blocked from the said administration, through our attorneys (Avv. ti Marco Ripamonti, Cino Benelli e Sandro Guerra), we have sent the last official letter to Dot. Gabriella Alemanno in which we allow an additional twenty four (24) hours for the reestablishment to internet to take place. Failure to do so in the twenty four hours allowed the company, Astrabet Ltd will have no other way but to inform the Judicial Authority about the behaviour of the Administration with the intent to assess eventual penal responsibilities for the facts mentioned, besides other legal action to protect our rights and to search compensation for any damage received.
In fact it is really incomprehensible that after more then thirty days from the court order, with immediate effect, it has not been possible do receive any kind of answers from the Italian Administration. The same Administration that on the 23rd of February 2006 said that they entrust with total confidence to the decisions of the Magistracy.
In separate news, the Italian Administrative Regional Court rejected the appeals of Betfair, Ladbrokes, Unibet, William Hill and Stanley Betting International against Italian Treasury, AAMS and Italian betting operators, which claimed the blockade of their websites is in contrast with EC Treaty that guarantees the free movement of services.
