A New Jersey judge ruled that running an online gambling site is illegal

Despite the state Legislature has no legislation expressly prohibiting betting over the internet, a Superior Court Judge upheld an indictment against a New Jersey resident, Nicholas Drakos, who was charged with promoting gambling, conspiracy to promote gambling and money laundering between January and April 2004.

Drakos is alleged to have run a website instructing bettors on how to set up online accounts to bet on sports events.

The defense lawyer maintained Drakos was running the website without knowing he was committing a crime. But New Jersey prosecutors argued that, under state law, a person materially aiding any form of gambling activity is guilty of promoting gambling.

The Superior Court Judge, Vincent Ahto, said that simply because the Legislature has not gotten around to directly labeling internet gambling as a crime does not mean it is lawful.

And while the state\’s constitution quotes approved forms of gambling, including casinos, state-run lotteries and bingo games, there\’s no mention of internet gambling.
