i self exluded on paddy power in 2013 for life but betfair have kept my account open and i have been making deposits since they merged and only on saturday they closed my account after many emails they say that i wont get any thing back due to there terms and conditions and the basicly says if i won they wont pay would have closed the account down
here are the last 2 eamils

Furthermore on top of what has already been said below, our Responsible Gambling team have added :

At the time of your self-exclusion with Paddy Power on the 30/10/2013 both companies had not yet merged. Following the merger of Paddy Power and Betfair on 2nd February 2016, we had measures in place whereby players are signposted to our sister companies and our self-exclusion processes if required. As a business, we are making progress in terms of sharing knowledge and data and will continue to improve and align our processes and policies.

As part of this, a new policy was implemented for customers who self-excluded from the 30th of December 2016 going forward to have their account on the other brand also self-excluded within 24-48 hours, and customers are informed of this at the time in advance. Self-exclusions applied prior to the 30th December 2016 are not included in this policy. We sign posted customers who self-excluded on either brand prior to the 30th of December that if they wanted to self-exclude from both brands they would need to contact them directly.

Unfortunately, we would not be offering any refunds as we feel reimbursing is in itself an incentive to gamble and encourages the behaviour to continue.

We take the position we do, in line with professional addiction advice, to avoid such an outcome and believe it is a responsible approach.

We would recommend you contact GamCare an independent organisation that will offer confidential, practical, sympathetic advice and support: GamCare - 0808 8020 133 / www.gamcare.org.uk .

If you wish to proceed to dispute resolution, IBAS are the appropriate body and can be contacted at adjudication@ibas-uk.co.uk.

Kind regards

Thanks for getting in touch.

We have received your complaint in regards to the e-mail sent to you.

The e-mail was in fact as an advisement from the Responsible Gambling team follwojng your request to review your account closure. They have advised us that that is their final decision in regards to your account and will not be in a position to do so again.

I do apologise if you felt the tone in the e-mail was patronising, we assure you that was not our intention.

As previously advised, should you wish to take it further, then IBAS are the appropriate body and can be contacted at adjudication@ibas-uk.co.uk.

Apologies if this is not the answer you wished to hear.

Hard to give any opinion without being able to read your original request which they refer to above.

They will be supported by IBAS in their position that refunding lost funds to self excluded players goes against the aims of the govt policy though. So doubt you have any chance of getting them to agree.

You could start a legal action and try to scare them into settling or risk a fine if a court finds against them though.

You'd be best to seek proper legal advice on your particular circumstances and the viability of trying that.

Yes it would behoove you to explain more in detail the situation. However with IBAS supporting their position it will be rather difficult to gain access to any money. Legal advise seems to be the path here.

Betfair provides a self-exclusion facility to help you if you consider that you need to control your gambling. For information on responsible gambling, please click here.

If you request a self-exclusion, we will, as soon as is reasonably practicable, apply best practices to prevent you from using your account indefinitely. To this end, we may retain such personal data as is necessary (and for as long as is necessary which may be indefinitely) to implement the facility as effectively as possible (including for example your name, address and credit/debit card details).

Our self-exclusion facility involves a joint commitment between Betfair and you. During a period of self-exclusion, we will take reasonable steps to prevent you re-opening your Account or opening a new Account but you must not attempt to re-open your Account or to try and open new Accounts.

You agree that you will not access any other Betfair account to use any of our services or products from which you have excluded, during the period of any such self-exclusion. You agree that: (i) if you hold accounts with both Betfair and Paddy Power and have self-excluded from an account on either site, you will not access any account which you hold on the other site (and we reserve the right to prevent you from attempting to access such other site) and (ii) if you hold an account with either Betfair orPaddy Power and have self-excluded from either site, you will not attempt to register an account with the other site during your period of self-exclusion (and we reserve the right to prevent you from registering an account with such other site).

Self-excluding from Betfair will not affect your marketing preferences with third parties, including with advertising websites or other third party affiliates. We strongly recommend that you also contact such third parties and opt out from receiving any gambling related communications from them.

To activate our self-exclusion facility, please contact our customer services.

With effect from 30 December 2016, if you apply a self-exclusion to your Betfair account, we will also try to prevent you from accessing any account which you hold with Paddy Power (for the same period of self-exclusion that applies to your Betfair account). However, there may be circumstances (including where we are unable to link your Betfair account to your Paddy Power account) where we are unable to do so. For certainty, we therefore recommend that, where you apply a self-exclusion to your Betfair account, you also do so to your Paddy Power account (and any other online account which you hold).

Please note that, if you applied a self-exclusion to your Betfair account before 30 December 2016, we will not automatically take steps to apply that self-exclusion to your Paddy Power account. In these circumstances, we recommend that you separately seek a self-exclusion to your Paddy Power account (and any other online account which you hold). If you applied a self-exclusion to your Betfair account before 30 December 2016 and also wish to self-exclude from your Paddy Power account, you can do so via your online Paddy Power account or, alternatively, by contacting our customer services.

If you apply any player protection tools (e.g. Deposit Limit, Product Exclusion, Reality Check, Loss Limit) to your Betfair Account, we will not take steps to apply the same player protection tool(s) to your Paddy Power account and we recommend that you separately seek to apply those player protection tools (or their equivalent) to any other online account which you hold (including your Paddy Power account). You will inform us as soon as you become aware of any errors in respect of any player protection mechanisms we make available to you. If you do not inform us when you become aware of such errors, then we shall not be liable for any losses which you may suffer.

We shall not be liable for any losses you may suffer if you circumvent our self-exclusion procedures and continue to use our products or services or if you continue to gamble with any third party.

Yes it is a serious breach if they do not administer self exclusion properly. Books have been fined huge amounts in the last few years over it in the UK.

That's why you may have a chance to scare them with a court action.

But I have heard this line before from other books that refunding losing bets or paying out any winnings both go against the intent of the UK laws. So I think they think they are on solid ground doing this to you.

How much money are you looking at here?

im in the uk betfair phone service is in malta no chance to this without a solicitor

Oh sorry. Thought you meant the Malta Gaming Authority, who license Betfair outside the UK.

Try that solicitor I mentioned above. They have helped another player with a self exclusion dispute and should KNOW for sure what options and chances you really have. Without having to spend a cent.

joanne does not deal with this issue i was told and the other selachi not answering you think theres any chance to do this without any legal help or is this the only option left ?

I doubt you will get far but you may as well go through the process of asking IBAS to rule on it.

I'd suggest keeping your complaint to them short and to the point. Just tell them you self excluded from PaddyPower and Betfair continues to allow you to bet there and you think they should be forced to refund your money. Let them work out the details for themselves and you'll be more likely to get an answer quicker, or at all.

But I do think legal action is your only real option. And I hate to say it, but if Joanne brushed you off, it likely means she doesnt think you have any chance. :( Same thing if a solictor starts telling you it;s going to cost a lot... they basically think you wont win.
