Nhappen. Generally if there's 1 odd hold out such as this, the foreman will ask about their thought process, and if they are relying on something not in the record, then there could be additional instructions from the judge....however- that usually just makes a hold out "dig in".

Actually- I shouldn't say that because NY is so wacky anything could happen, they might actually swap an alternate juror but that'd be grounds for appeal.
